As a 100% Disabled-owned business, we know all too well what it means to be Disabled by Society. That’s why we are on a mission to take exclusion to inclusion, transforming Disability inequities.
Disabled by Society partners with clients to create bespoke solutions which support them to unlearn ableism, inequity, and inaccessibility across their organisation and wider society. Transforming the way, they design, support, learn, and view Disability. Our solutions provide you the tools and knowledge to create workplaces, products, and services that are accessible and inclusive. Where candidates, colleagues, customers, and clients feel included, represented, and have the opportunity to participate and belong.

1. Introduction
(Last updated Monday 28th October 2024) Our aim is to keep this Agreement as readable as possible, but in some cases for legal reasons, some of the language required is “legalese”. These terms and conditions as an acknowledgment and understanding of the principles and code of conduct that Disabled By Society stand for and therefore expect from their partners.
2. Your Acceptance of this Agreement
These terms of service are entered into by and between You and Disabled By Society (“Company,” “we,” “our,” or “us”). Our Company number is 16027443. The following terms and conditions, together with any documents we expressly incorporate by reference (collectively “Terms of Service”), govern our collaboration, including any content, functionality, and services offered on or through www.disabledbysociety.com (the “Website”) or through any associated communication channels.
Please read the Terms of Service carefully before you start.
By using the Website or our services [or by clicking to accept or agreeing to the Terms of Service when this option is made available to you], you accept and agree to be bound and abide by these Terms of Service and our Privacy Policy, found at /privacy-policy, incorporated herein by reference. If you do not want to agree to these Terms of Service, you must expressly state this to Disabled By Society in the most accessible method of communication to you.
Individuals under the age of 13 years may use the Website or our services if enabled by a parent or legal guardian. If you are a parent or legal guardian of a user under the age of 18, by allowing your child to use the Website or our services, you are subject to the terms of these Terms of Service and responsible for your child’s activity.

5. To impersonate or attempt to impersonate the Company, a Company employee, another user, or any other persona or entity (including, without limitation, by using email addresses associated with any of the foregoing).
6. To engage in any other conduct that restricts or inhibits anyone’s use or enjoyment of the website, or which as determined by us, may harm the Company or users of the website, or expose them to liability.
Additionally, you agree not to:
1. Use the Website or our services in any manner that could disable, overburden, damage, or impair the site or interfere with any other party’s use of the Website, including their ability to engage in real-time activities through the Website.

Shipments & Delivery
We will arrange for shipment of the goods to you. Please check the individual product page for specific delivery options. You will pay all shipping and handling charges unless otherwise specified in the order confirmation.
Title and risk of loss pass to you upon our transfer of the products to the carrier/delivery. Shipping and delivery dates are estimates only and cannot be guaranteed. We are not liable for any delays in shipments.
10. Payment and Fees
You may be required to purchase or pay a fee to access our services. We accept Mastercard, Visa and American Express for all purchases. However, Disabled By Society does not guarantee the availability of any payment method at any moment and Disabled By Society may add, remove or suspend any payment method temporarily or permanently at Disabled By Society’s sole discretion. You agree to provide current, complete, and accurate purchase and account information for all purchases made via the Website or directly, and to promptly update account and payment information, including email address, payment method, and payment card expiration date, in order to complete your purchases and contact you as
needed. Sales tax may be added to the price of purchases as deemed required by us. We may change prices at any time. All payments shall be in GBP.
You agree to pay all charges or fees at the prices then in effect for your purchases, and you authorise us to charge your chosen payment provider for any such amounts upon making your purchase.
We reserve the right to correct any errors or mistakes in pricing, even if we have already requested or received payment. We also reserve the right to refuse any order placed through the Website.
For larger purchases over £1,000 for procurement of service, a 50% deposit will be required, payable within a reasonable time frame before enacting
11. Return and Refund
If you are not completely satisfied with your purchase, Disabled By Society will always aim to rectify any errors and reach an individual agreement with you in regard to the purchase. If a refund is issued, refunds may take 1-2 billing cycles to appear on your credit card statement.
12. Disclaimers, Liability and Indemnification

13. Copyright Infringement

If a counter-notice is received we may send a copy of the counter-notice to the original complaining party informing that person that it may replace the removed content or cease disabling it in ten business days. Unless the copyright owner files an action seeking a court order against Disabled By Society or the person who has posted allegedly infringing content, the removed content may be replaced, or access to it restored, in ten business days or more after receipt of the Counter-Notice.
Disabled By Society does not condone or tolerate copyright infringement or any violation of the intellectual property rights of Disabled By Society or of others. Disabled By Society reserves the right to terminate the access and/or use privileges of any person who has been determined to be a ‘repeat infringer’ of Disabled By Society or others.

15. Governing Law
The Website and these Terms of Service will be governed by and construed in accordance with the laws of The United Kingdom and any applicable laws applicable therein, without giving effect to any choice or
conflict of law provision, principle, or rule and notwithstanding your domicile, residence, or physical location. Any action or proceeding arising out of or relating to this Website, services and/or under these Terms of Service will be instituted in the courts of The United Kingdom, and each party irrevocably submits to the exclusive jurisdiction of such courts in any such action or proceeding. You waive any and all objections to the exercise of jurisdiction over you by such courts and to the venue of such courts
The parties agree that the United Nations Convention on Contracts for the International Sale of Goods will not govern these Terms of Service or the rights and obligations of the parties under these Terms of Service.

If any provision of these Terms of Service is illegal or unenforceable under applicable law, the remainder of the provision will be amended to achieve as closely as possible the effect of the original term and all other provisions of these Terms of Service will continue in full force and effect
17. Entire Terms of Service
These Terms of Service constitute the entire and only Terms of Service between the parties in relation to its subject matter and replaces and extinguishes all prior or simultaneous Terms of Services, undertakings, arrangements, understandings or statements of any nature made by the parties or any of them whether oral or written (and, if written, whether or not in draft form) with respect to such subject matter. Each of the parties acknowledges that they are not relying on any statements, warranties or representations given or made by any of them in relation to the subject matter of these Terms of Service, save those expressly set out in these Terms of Service, and that they shall have no rights or remedies with respect to such subject matter otherwise than under these Terms of Service save to the extent that they arise out of the fraud or fraudulent misrepresentation of another party. No variation of these Terms of Service shall be effective unless it is in writing and signed by or on behalf of Company

No failure to exercise, and no delay in exercising, on the part of either party, any right or any power hereunder shall operate as a waiver thereof, nor shall any single or partial exercise of any right or power hereunder preclude further exercise of that or any other right hereunder

We may provide any notice to you under these Terms of Service by: (i) sending a message to the email address you provide to us and consent to us using; or (ii) by posting to the Website. Notices sent by email will be effective when we send the email and notices we provide by posting will be effective upon posting. It is your responsibility to keep your email address current.

21. Principles
Disabled By Society is upheld on the principles of equity, inclusion and accessibility and will therefore always take reasonable steps to ensure that all materials, services, websites, communications, marketing and any other materials, are as accessible as possible, as standard practice. Disabled By Society therefore expects its partners and clients to therefore take the same necessary measures, when communicating with the company, promoting the company, sharing company information or materials or raising awareness, and is happy to provide guidance where needed.
Disabled By Society does acknowledge, that due to a lack of education around Disability equity, conscious and unconscious biases and inequitable treatment of Disabled people and other ‘protected characteristics’ may be occurring. Disabled By Society therefore expect in these incidents to witness an active commitment to objectives and values to the best of your ability, with an open commitment to progression forward
Disabled By Society operates upon the fundamental aim of eradicating ableism, discrimination, prejudice or ‘less favourable treatment’ in accordance with The Equality Act (2012) and international law. Disabled by Society has a zero tolerance policy for these behaviours, and where identified, solution provided and these issues fail to be rectified and are made public or not corrected, Disabled By Society holds the prerogative to terminate agreements, access or service provision
22. Defamation
By working alongside, partnering or promoting Disabled By Society, clients, partners and customers agree to not act in a manner which if defamatory or slanderous of the company.
Defamation occurs when the defendant publishes a statement which tends to lower the claimant in the estimation of right-thinking members of society. Defamation therefore has three requirements:
1. The statement must be defamatory (ie. the statement must have a negative impact on the claimant’s reputation);
2. The statement must identify or refer to the claimant; and
3. The statement must be published by the defendant to a third party.
Defamation is divided into two sub-categories: libel and slander.
Libel is the publication in permanent form of a defamatory statement (eg. a newspaper article). Slander is the publication of a defamatory statement in transitory form (eg. a spoken statement). It is generally accepted that bulletin board exchanges on the internet are technically libel rather than slander.
Due to the ambiguity of defamation law, in order to protect Disabled By society, we will request the removal of any statement which is defamatory, harmful, or derogatory to the organisation.
Safeguarding. Every child has a right to protection from harm. All organisations that work with or come into contact with children should have safeguarding policies and procedures in place to help them keep children safe.
23. Safeguarding
Disabled By Society acknowledge the duty of care to safeguard and promote the welfare of children and adults and are committed to ensuring safeguarding practice reflects statutory responsibilities, government guidance and complies with best practice.
Disabled By Society as a core value ensures the safeguarding of its company employees, freelancers, contractors, clients, partners and users, and therefore expects any partners, clients and customers to ensure the same protections are in place
24. Social Media
Disabled By Society regularly uses social media to interact and engage with various communities, as well as raising awareness and promoting Disability in the most accessible way possible. We use a number of social media platforms to do this.
Disabled By Society takes every effort to make sure our social media channels, or B2C profiles are safe, open, honest and friendly space for our users, and ask that you keep your comments, posts and responses on-topic and respectful. By using, interacting or featuring on our social media channels you agree to the following guidelines.
1. Engage in friendly discussion/debate.
2. Sharing views and opinions with respect of others.
3. Using polite, appropriate and respectful language.
4. Not harassing, bullying or attacking members of staff, partners, volunteers or clients of Disabled By Society, or members of the public.
5. Not impersonating accounts of individuals associated with disabled By Society.
6. Being as accessible as possible (Disabled By Society acknowledges the restraints of some platforms in terms of accessibility)
7. Not using defamatory, derogatory or negative language to describe or discuss our principles, or deliberatively provoking or disrupting conversation.
8. Please note that the appearance of external links or comments on our pages does not constitute official endorsement on behalf of Disabled By Society.
9. Not posting material deemed to be defamatory, obscene, indecent, lewd, pornographic, violent, abusive, insulting, threatening, harassing, harmful, obscene, profane, blasphemous, sexually oriented, racially offensive or discriminatory or which might incite people to commit any crime or is otherwise unlawful or illegal; any such posting will be removed without warning.
10. Not spamming or trolling our channels or platforms or any other members of the public, spam and authorised advertisements will be removed.
11. Disabled By Society reserves the right to delete posts at our discretion.
12. Disabled By Society reserves the right to reply or interact with comment and engagements at our discretion.
25. Use of Services
Events (such as training, speaking, conferences…
If you no longer want to attend an event that you have purchased a place on, or circumstances mean you cannot attend, you must let us know by direct communication at the earliest convenience.
You may transfer your place to another suitable individual in your organisation up to and including on the day of the event – we would ask that you get in touch at your earliest convince. If this is not possible then please let us know – at our discretion we may transfer your booking to another event.
If you are not able to attend and cannot transfer your place to another person, cannot transfer to another course or do not contact us as above, your place will still be charged at the stated rate for the event.
The event booking is only for the named person that has made the booking (subject to any changes we have agreed). Any extra attendees who join the event will be charged at full rate retrospectively (subject to the course not being at full capacity) and we reserve the right to request that the additional participants leave the event if its is full.
